These terms and conditions (the "Agreement") describe what you are legally entitled to expect from us when you book your trip through us, in addition to important obligation you make as a customer that effect your legal rights. The terms "we", "us" and "our" “Operator” and “Great Value Vacations” refer to Great Value Vacations The term "you", “participant”, “passengers” and “client” refers to the customer visiting our website, and/or booking a reservation through us.

It is the passenger’s responsibility to understand the following terms and conditions. By booking travel with Great Value Vacations,”, the passenger agrees to adhere to and accept all the terms and conditions of the Agreement and any additional terms and conditions of any Supplier that are applicable to your booking arrangements. If you do not agree with any of these terms and conditions, you must not make a booking with us.

By making a booking with us, you affirm that you are at least 21 years of age and possess the legal authority to enter into this agreement in accordance with all Terms and Conditions herein. If you are making travel reservations or bookings for another person you agree to inform that person(s) about the Terms & Conditions that apply to the travel reservations and bookings you have made on their behalf, including all rules and restrictions applicable thereto and these Terms and Conditions. You agree to be financially responsible for all bookings you make. You are responsible for any bookings and travel reservations made by persons under your direction or control. You also warrant that all information supplied by you or on your behalf, or by members of your household is true, current, complete and accurate.

You agree that any violation of any such terms and conditions may result in (a) the cancellation of your reservation or purchase, (b) your forfeiture of any monies paid for your reservation or purchase, (c) you being denied access to the applicable travel related product or service, and (d) our right to debit your account for any costs we incur as a result of such violation.

You acknowledge and agree that we may change these terms and conditions from time to time and that those changes become effective immediately. You agree to be bound by the terms and conditions that are in effect at the time of your travel or at the time of cancellation, if applicable. You agree that is your responsibility to be familiar with these terms and conditions and to check back from time to time for any changes.

IMPORTANT AIR AND LAND PACKAGE INFORMATION

All payments are non-refundable and non-transferable. Air seats are limited and prices may be restricted to specific flights, class of service, travel dates, or length of stay. Holiday periods, flights and dates outside of specified travel period are available at additional costs. Accommodations include applicable taxes. An optional Travel Protection Plan will be offered during the booking process and if purchased, you will be allowed to cancel subject to the below terms. If you have not purchased our Travel Protection Plan, all bookings are Non-Refundable. Offers apply to North American-originating passengers and Fees are subject to change without notice and will be confirmed at time of booking. Flight restrictions/terms & conditions apply. Frequent flyer mileage/points may not apply. Tickets are non-refundable. For some flights from the United States, you may cancel the ticketed reservation without penalty and receive a refund provided that you cancel the reservation within 24-hours after making it, if the reservation is made one week or more prior to a flight's departure. This is subject to the terms of the specific carrier. It is your responsibility to be aware of your carrier’s cancellation terms. Stopovers are not permitted unless specified. Hot Deal offers cannot be combined with any other discounts/promotions. Child/infant discounts not available. Substantial restrictions apply for cancellation/changes. FINAL PAYMENT

Full payment, including insurance payment, must be made at time of booking. We accept the following Credit Cards: MasterCard, Visa, and Discover. Unless otherwise advised, the credit card selected will be charged for entire balance of the reservation. Purchaser's credit card will be charged by Global Consolidated Services (GCS) and will appear as follows on credit card statement: "Great Value Vacations”.

OUTBOUND FLIGHTS (departing to your destination)

Please be sure to check with your airline and check destination requirements related to Covid-19. You may require a negative test within a specified period of time to travel on your outbound flight. It is your responsibility to ensure that you meet the appropriate requirements. Countries continue to change requirements on a regular basis. Make sure you are aware of the latest regulations.  While there are many different types of Covid-19 tests available, some tests may not be accepted by airlines or destinations. We recommend that you get a PCR test, as these are the most widely accepted.  Please ensure that you have checked the requirements for ALL COUNTRIES that you will be visiting.  You must meet each country’s requirements, even when traveling from another country that you have already been approved to enter.

INBOUND FLIGHTS (returning to US)

All air passengers to the United States are required to provide contact information to airlines before boarding flights to the United States.

Consider getting tested with a viral test as close to the time of departure as possible (no more than 3 days) before travel.

Make sure you know your test results before travel.

Don’t travel if your test result is positive.

Non-U.S. Citizen, Non-U.S. Immigrants:

Air Travel: All non-U.S. citizen, non-U.S. immigrants traveling to the United States by air are required to show proof of being fully vaccinated against COVID-19. 


COVID-19 ADVISORY

Due to the Covid-19 pandemic, there may be some things that arise/change prior to or during travel that we would like to make you aware of. We believe that sharing this information will help manage expectations and allow you to have an enjoyable experience. We are doing our best to monitor everything, but you will also need to make yourself aware of quickly changing requirements and updates. Information can be found on government, airline, resort and destination websites.

Where possible, we will get in touch with you regarding key changes that may impact your trip and discuss appropriate substitutions.  GVV will provide refunds for any included services that cannot be provided.  This applies to anything outlined in the “What’s Included” portion of your package and does not apply to full trips that may be postponed.

 Here are some things you may or may not experience and by traveling, you acknowledge that you understand and accept any measures put in place by the destination, airline, transfer company and resort, such as:

 •   Destinations may be requiring pre-arrival documentation (we will do our best to make you aware of this, but you should also be checking for any special requirements such as testing

 •   Flight schedules can change

 •   Temperature taking or other medical policies may be in place

 •   Masks and gloves may be mandatory  

 •   Inflight services may be interrupted

 •   Hotels may impose special precautions or additional rules

 •   Hotels may not be at full occupancy as they practice distancing

 •   Hotel staff may be limited

 •   Room service might not be available

 •   All restaurants and bars might not be open

 •   Entertainment may not be available

 •   Spa/gym and any social activities may be closed or canceled

 •   Tours might be canceled or on limited availability

 •   Curfews may be put in place

 •   Any other measures as determined by resorts and airlines

Because policies and procedures are beyond our control and are being updated often and ever changing, please check the airline, resort and destination websites each day leading up to travel for any updates or changes. 


TRIP PROTECTION

We strongly advise the purchase of a Travel Protection Plan. The applicable Travel Protection Plan options below will be available with your purchase. Additional details will be provided on your Itinerary and Travel Protection Plan Voucher travel documents upon purchase.

Declining trip protection could result in the loss of your travel cost and/or require more money to correct the situation. You also acknowledge that without insurance, there may be no way to recoup any losses, costs or expenses incurred. If you choose to travel without adequate insurance coverage, we will not be liable for any of your losses howsoever arising, for which insurance coverage would otherwise have been available.

Travel Protection Plan 1 (excludes Escorted, Golf, Cruise, Rail and/or Group Vacations)

This coverage is designed to protect your investment on all featured self-drive and customized bookings. Coverage goes into effect on the day the premium plan payment is received. This coverage must be purchased within 48 hours after booking. This travel protection plan consists of a Part A non-insurance Pre-Departure Trip Cancellation Waiver (provided by Global Consolidated Services USA, Inc.) and Part B insurance benefits (underwritten by United States Fire Insurance Company) along with other non-insurance travel assistance services. Under the non-insurance Part A of this plan you may cancel your trip up to 72 hours prior to departure for any reason and you will receive a credit for future travel equaling the full amount of all payments made, less any Travel Protection Plan Cost and fees. Passengers must rebook their vacation using original air carrier at least 72 hours prior to originally scheduled departure and complete travel at least 1 year from original booking date. Please note that basic economy, prepaid instant purchase airfares, and group airfare are not eligible for coverage and are subject to airline-imposed change or cancellation fees based on airline rules at the time that the change is requested. Pre Departure notice of cancellation must be made by calling (866) 320-2161. Note: Inside 72 hours prior to travel, full cancellation penalties will apply. Plan fees are not refundable at any time.

 A full description of insurance benefits can be found under Part B of the travel protection plan. Benefits include, but are not limited to, Travel Delay, Accident & Sickness Medical Expense and Lost Baggage. Part B also contains non-insurance travel assistance services, available to you 24/7 offering help with anything from hotel arrangements to translations services. Please be advised should you cancel your booking and your package has shared accommodations or services you will receive a credit for your airfare (less cost of Trip Protection Plan). Since the shared services are still being used by other members in your traveling party there will be no credit available for those shared services.

Travel Protection Plan 2 (applies to Escorted, Golf, Cruise, Rail and/or Group Vacations)

This travel protection plan consists of insurance benefits (underwritten by United States Fire Insurance Company) and other non-insurance travel related assistance services. This plan is also offered through Trip Mate, a Generali Global Assistance & Insurance Services brand. This coverage is designed to protect your travel investment with a full cash refund less the cost of the insurance and cancellation fees for the following covered reasons such as death, sickness, injury or certain other covered reasons.

This travel protection plan is available for purchase at the time of booking. Coverage can help to protect you and your travel investments. Benefits include, but are not limited to, Trip Cancellation, Trip Interruption and Baggage Delay. Non-insurance travel assistance services are available 24/7 during times of need. You may obtain information on the plan fees by emailing assistancefees@tripmate.com. To review the plan document as well as important disclaimers, please visit http://tripmate.com/wpF421S. This coverage must be purchased within 48 hours after booking.

In-Destination Protection Plan

This In-destination coverage is designed to protect you while traveling on all featured travel packages excluding Escorted, Golf, Cruise, Rail and/or Group Vacations, if you have purchased Basic Economy flights.

This travel protection plan consists of insurance benefits (underwritten by United States Fire Insurance Company) and other non-insurance travel related assistance services. You may obtain information on the plan fees by emailing assistancefees@tripmate.com. This plan is also offered through Trip Mate, a Generali Global Assistance & Insurance Services brand. Benefits include, but are not limited to, Trip Interruption, Travel Delay, and Baggage Delay. Non-insurance travel assistance services are available 24/7 during times of need offered by Generali Global Assistance. CANCELLATION AND CHANGE POLICIES

INDEPENDENT TRAVEL CHANGE AND CANCELLATION POLICY (excluding Escorted Vacations):

All payments are non-transferable and non-refundable. For some flights from the United States, you may cancel the ticketed reservation without penalty and receive a refund provided that you cancel the reservation within 24-hours after making it, if the reservation is made one week or more prior to a flight's departure. This is subject to the terms of the specific carrier. It is your responsibility to be aware of your carrier’s cancellation terms. All featured self-drive and independent package payments and customized booking payments are non-refundable and non-transferable whether bookings made through call center or website. We offer a cancellation waiver insurance plan that can cover cancellation for any reason up to 3 business days prior to departure. For air changes penalties vary. Minimum fee for changes to airline reservations is $100 per person per segment. Spelling corrections to clients’ names after tickets have been issued are subject to airline change fees. If documents have been issued a processing fee will apply to send revised travel documents. Fees are subject to adjustment at any time at the Tour Operator’s discretion.

ESCORTED VACATIONS CHANGE AND CANCELLATION POLICY

All Payments are non-transferable and non-refundable. For some flights from the United States, you may cancel the ticketed reservation without penalty and receive a refund provided that you cancel the reservation within 24-hours after making it, if the reservation is made one week or more prior to a flight's departure. This is subject to the terms of the specific carrier. It is your responsibility to be aware of your carrier’s cancellation terms. . All tours will incur a $50 fee per change to any land components plus any additional incurred costs. For air changes penalties vary. Minimum fee for changes to airline reservations is $100 per person per segment. Spelling corrections to clients’ names after tickets have been issued are subject to airline change fees. If documents have been issued a shipping fee will apply to send revised travel documents. Changes made inside of 45 days are considered a cancellation. Fees are subject to adjustment at any time at the Operator’s discretion. If you are booked in a double or twin room and your roommate cancels, you will be responsible for the single supplement. Name changes and transfers of reservations are not permitted.

TRAVEL OPERATIONS

Escorted Vacations/Cruise Vacations are co-shared with industry leading tour/cruise companies such as Globus and/or Brendan Tours. You benefit considerably from this collaboration through considerably lower tour prices and greater choice of itineraries and departure dates. Independent travel products/packages are operated by Global Consolidated Services USA, Inc., Rockville Centre, NY.

IF THE SUPPLIER CANCELS THE TOUR (APPLIES TO ESCORTED TOURS)

In the event the Supplier, for any reason, cancels your escorted vacation we will attempt to rebook clients on the same tour with the next available departure date or a similar tour. If there is no acceptable substitute the Supplier will issue a credit for future travel to the client; in this case there is no additional liability to the Operator and the Operator will not be liable for supplying any refund to you. 

REFUNDS FOR UNUSED SERVICES

No refunds will be made for unused services or vouchers once travel arrangements have commenced.

AIR ARRANGEMENTS
Operator is not responsible if an airline cancels, reschedules, or delays a flight for any reason. If you miss your departure flight, it is your responsibility to work with the airline on which you are ticketed to reach your destination. Operator is not responsible for any additional expenses you may incur prior to joining your trip. Operator is not responsible for and will not provide any refund for portions of trips missed due to canceled, rescheduled, or delayed flights.

For air purchased through Operator, if any air schedule requires an overnight stay in a gateway city, it is the client’s responsibility to secure accommodations is at client’s expense. Air routings are subject to availability. Routings are not guaranteed and are subject to change at any time.

If you make your own flight arrangements, Operator will not be responsible for any loss resulting from cancellation or changes in international gateways or travel dates. We recommend that you do not purchase airline tickets with high penalty charges for changes.

PARTICIPATION

For the benefit of everyone on your vacation, Operator reserves the right to accept or reject any vacation participant and to remove any participant whose conduct is deemed incompatible with the interests of the other participants. We will not refund nor cover any cost or expenses you incur if we have to terminate your vacation arrangements due to your unacceptable behavior.

When you book with us, you accept responsibility for any damage or loss caused by you. Full payment for any such damage or loss (reasonably estimated if not precisely known) must be paid direct at the time to the accommodation owner or manager or other supplier. You must indemnify us for the full amount of any claim (also including legal costs) made against us. Operator is not responsible for any costs incurred concerning a participant removed from a vacation/holiday. Participants agree not to hold Operator or any of its related entities liable for any actions taken under these terms and conditions.

Baggage and personal effects are at all times the sole responsibility of the participant.

TRAVELERS WHO NEED SPECIAL ASSISTANCE

You must report any disability requiring special attention while on tour or on cruise to Operator at the time the reservation is made. Operator will make reasonable attempts to accommodate the special needs of disabled travelers, but is not responsible in the event it is unable to do so nor is it responsible for any denial of services by air carriers, hotels, restaurants, or other independent suppliers. The Americans with Disabilities Act is only applicable within the United States and facilities for disabled individuals are limited outside its borders. Most transportation services, including the touring motorcoach, are not equipped with wheelchair ramps. We regret that we cannot provide individual assistance to a vacation participant for walking, dining, getting on and off motorcoaches and other vehicles, or other personal needs. A qualified and physically able companion must accompany travelers who need such assistance and must assume full responsibility for their well-being.

Although some of our supplier’s ships have elevators, many of the supplier’s small ships (e.g. river cruise vessels) do not. Passengers requiring ship elevators should inquire before making reservations. Additionally, most stateroom doors and restrooms are not wide enough to allow access by standard wheelchairs, and bathrooms and other doorways may be fitted with coamings. For safety reasons, passengers in wheelchairs cannot be carried on ramps in ports where the ship is at anchor. Motorized scooters are not typically suitable on international tours or river cruises.

YOUNG TRAVELERS

Travelers who are less than 18 years old on the departure date must be accompanied by an adult and share an adult’s accommodations throughout the duration of the vacation. There are no young traveler discounts however we do accept children ages 8-17. Some of our Suppliers have restrictions for children under 8 years old. We will tell you if this applies at the time of booking. For any special requirements regarding airline tickets for children, contact your airline directly.

Due to heightened security, many countries have adopted practices to prevent international abductions of children. If a child will be traveling with adults other than the parents or with only one parent, it is recommended that a notarized letter be written by the parents or non-traveling parent granting authorization to travel, including the dates of travel. We suggest that you also contact the appropriate consulate and airlines because they may have additional requirements or recommendations.

SMOKING
Smoking is not allowed on transportation that is exclusively provided by Operator. Passengers should check the smoking policies at individual hotels, airlines, cruise lines etc., for more specific information.

PRICES
All package prices listed herein are per person and are based on double occupancy unless otherwise noted. Prices are subject to change. Prices include airfare to and from your destination as outlined in your vacation package. Connecting airfare and flights within certain destinations may not be included. Contact one of our vacation specialists to acquire up to the minute air rates.

PLEASE NOTE: All rates are shown based on the currency selected in the currency toggle at the top of the website, rates include all carrier and government-imposed taxes/fees/facility charges and the September 11th Security Fee of $5.60 for US enplanements. Airline-imposed baggage or service fees may apply and be due at the airport; please consult your airline prior to departure for the latest fees. These rates are based on exchange rates, tariffs and tax rates in and may be subject to change without notice. Each individual vacation package price includes charges for research, itinerary preparation and planning, currency transfer and booking procedures. In each case, the quoted price represents a complete package price and an itemization of individual component prices will not be rendered under any circumstances. Rates may not apply to Christmas, and New Year’s season. Supplements may be required for other holidays and may vary by destination.

VISAS & PASSPORTS
You are responsible for obtaining and paying for all visas and entry documents, for meeting all health and other requirements, and for any documents required by the laws, regulations, orders, and/or requirements of the countries you will visit. Non-U.S. citizens must consult with appropriate consulates to determine if any visas are needed and are responsible for obtaining all visas and entry documents independently. Operator is not responsible for providing you with specific visa and passport information or documentation and Operator cannot accept liability for any passenger refused entry onto any transport or into any country due to failure of the passenger to carry correct documentation. All passengers traveling internationally are required to have a passport. Most countries require that the passport be valid for at least six (6) months beyond the conclusion of your trip. It is recommended you have a minimum of three blank pages in your passport when traveling, as many countries require blank pages. Multiple-entry visas are required for some vacations. It is your responsibility to verify all visa and passport requirements.

Non-U.S. Passport holders may require an eTA (Electronic Travel Authorization) if their flight connects through Canada. Please visit http://www.cic.gc.ca/english/visit/eta.asp for more information.

ACCOMMODATIONS
The accommodations listed on the website are intended to be used on all departures; however, if a change becomes necessary for any reason, including additional departures on the same date, the accommodations substituted will be equivalent to those shown. All accommodations are arranged as stated herein. We reserve the right to substitute hotels, car models, golf and sightseeing listed herein for similar product categories as conditions may require. Hotel rooms in some international countries are typically smaller and less standardized than those in the United States and do not always offer air conditioning and other amenities. Please note that a “twin room” generally includes 2 twin beds placed side by side. Single rooms often only include one twin bed and are smaller than twin sized rooms. Triple rooms (3 guests in a room) will typically be accommodated with 1 bed for 2 people (double) or 2 beds for 2 people (twin) and a roll away/cot for the 3nd guest. 

Please note that accommodation check-in times vary worldwide. It is standard hotel policy that hotel check-in is generally not possible before 2:00 p.m. local time.

PRIVATE BATH AND SINGLE ROOMS
In exceptional cases where private baths or single rooms reserved by us are not available, refunds will be made by the Supplier. Claims made in this respect cannot be accepted after the vacation is completed.

OPEN B&B VOUCHERS
Acceptance of B&B vouchers by hotels is at the sole discretion of the proprietor, as is any supplement charged. No refunds will be issued for unused vouchers or of vouchers presented as payment to B&Bs of a lesser price category. It is the client’s responsibility to secure their own reservations with the individual B&Bs under the open voucher program. The Operator can, in certain circumstances, pre-book a B&B on the clients’ behalf for an additional fee. Clients must consult the written instructions, terms and conditions listed in any B&B literature provided after booking. Supplements per room per night may apply during peak months and are payable direct to homeowners.

Please note: In the event that you cancel your reservation, IT IS YOUR RESPONSIBILITY to cancel all B&B reservations directly with the B&B properties (for Ireland) and/or The Circle (for Scotland/UK). 

CAR RENTAL INFORMATION

Ireland Car Rentals

VIP Express Insurance on car rentals is available to be booked prior to departure at a discounted rate. This coverage will confirm a "zero" deductible, walk-away policy covering any damage to the vehicle.

We strongly recommend purchasing VIP Express Insurance at time of booking. If you choose not to take the VIP Express Insurance you will be held fully responsible for any damage to the rental vehicle.

You will have unlimited third party insurance as part of the package but this will not cover any damage to your rental vehicle should you decline to purchase the VIP Express insurance.

VIP Express insurance is comprehensive in nature; however, it does not cover damage to the vehicle due to gross negligence. Gross negligence is defined as a conscious and voluntary disregard of the need to use reasonable care, which is likely to cause foreseeable grave injury or harm to persons, property, or both. If you are in any doubt as to your ability (or any of your approved additional drivers' ability) to drive a manual/stick shift vehicle you should seriously consider rental of an automatic transmission vehicle. This will eliminate the potential to damage a clutch.

Driver Supplements are as follows and must be paid to car rental company at the time of the car pickup in Ireland:

Minimum age: 21 years through 24 years - There is an insurance surcharge of €30 per day plus tax.

Maximum age: There is no maximum age for drivers in Ireland; however, all drivers aged 71 years or more must rent an "automatic transmission" vehicle. They must also produce their insurance policy which states they have coverage in their home country

Additional driver charge - approximately €10 per day plus tax

CREDIT CARD HOLD FOR LIABILITY
Any non-covered liability of the car is held on the client's credit card during the course of the rental and released after the car is returned in its original condition.

FUEL POLICY
All customers will be offered a full tank of fuel at a discounted rate and be requested to return the vehicle empty to eliminate any potential delays at check-in. The customer has the option to return the car full and in this case a refund for fuel charged at time of pick up will be provided.

(If you normally drive in the US please ensure you are putting the proper fuel in the car. In the US a green handle denoted diesel fuel but in Ireland a green handle denotes non-leaded fuel). Please always read the label.

UK Car Rentals (May vary dependent upon vendor)

Driver Supplements are as follows and must be paid to car Rental Company at the time of the car pickup in UK:

Minimum Age: 21 years through 22 years £14 per day plus tax

23 years through 24 years £7 per day plus tax

Vehicle License fee - £1.07 per day plus tax

Additional Driver fee - £2.50 per day plus tax

Location Surcharge of 13% of rental plus tax

SURCHARGES AND FUEL FEES
The Rental Company at the time pick-up assesses a non-refundable location surcharge equal to 13% of the base rental fare. A gasoline charge for a full tank of gas is assessed at the time of pick-up at standard gas rates. Any non-covered liability of the car is held on the client’s credit card during the course of the rental and released after the car is returned in its original condition.

Italy Car Rentals (May vary dependent upon vendor)

Driver Supplements are as follows and must be paid to car Rental Company at the time of the car pickup in ITALY:

ADDITIONAL RENTAL FEES
Additional fees for after-hours pickup, one-way drop offs, additional equipment apply. Customers with rentals of 5 days duration and over will be asked to purchase a full tank of fuel up front and return empty. A security deposit of €250 will be held at time of pick up. CDW is included in your rental cost with zero deductible. Any non-covered liability of the car may be held on the client’s credit card during the course of the rental and will be released after car is returned in original condition.

BAGGAGE ALLOWANCE
Porterage for one suitcase is included in the vacation price. Airport porterage is not included unless otherwise specified in your travel documents. Due to limited capacity, your single bag should have dimensions not exceeding 30"x18"x10" and weight not exceeding 50lbs (22kg). Your air carrier may have stricter weight/dimension limitations. Some vacations have more restrictive regulations than these listed above. Please refer to your Travel Documents for more information.

Size and weight limitations for carry-on and checked baggage vary from airline to airline and even according to destination, and are becoming more restrictive. Some airlines are also charging fees for checked baggage, including the first checked bag, and these fees are not included in the vacation package. Please check with your airline(s) directly for baggage information and regulations. Tour Operator is not responsible for additional fees imposed by air carriers regarding baggage. Regulations within most airports require that travelers handle their own luggage through customs. No responsibility is accepted for loss of or damage to baggage or any of the traveler’s belongings throughout the duration of the vacation. Insurance is recommended.

Carry-on bags should not exceed the dimensions of 12"x11"x6". For safety reasons, wheeled carry-on bags are not suitable as hand luggage Carry-on bags must be small enough to store in overhead bins or under the seat in front of you. We regret that we are unable to accept a second suitcase or any luggage exceeding the guidelines above. An additional fee may be collected by the Tour director directly is the above conditions are not strictly adhered to.

NOT INCLUDED IN YOUR VACATION PRICE
Some fees which are not included in your vacation may be the following: Local City tax; resort fees; passports; visas and vaccinations; tips to your Tour or Cruise Director, Local Host, driver, Local Guides, and/or ships' crew; gratuities on ferries, trains, and cruise ships; laundry; telephone; minibar; alcohol, beverages, and food outside of the contracted Operator menu as presented at a hotel or restaurant (these extra items will be billed to you before leaving the hotel, ship, or restaurant); optional excursions; airport transfers on non-qualifying flights; porterage at airports and train stations; Travel Protection premiums plan payments; excess baggage fees; and all other items not specifically mentioned.

REFUNDS
The Operator reserves the right to determine eligibility for requested refunds, subject to these terms and conditions and the terms and conditions of the suppliers. All claims for refunds must be submitted in writing within 30 days of end of travel date. Customarily there are no refunds on river cruises. Any claims not submitted within 30 days of the end of travel date will be considered waived and barred.

AIRPORT TRANSFERS
Airport transfers can be added at time of bookings on qualifying flights and dates. Not all flights qualify. Customers not using the Tour Operator transfers will be solely responsible for arriving at port by time of departure

SPECIAL REQUESTS
Special requests if confirmed are subject to availability. When making a purchase on the website, you expressly accept the possibility that the Operator may not satisfy such special requests. No purchase or reservation may be canceled based on the failure of Operator to satisfy special requests. You agree that you will be responsible for any additional charges for special requests.

WEB BOOKINGS
Website contains special pricing that is exclusively for Internet sale only. Bookings made through our call center may incur a fee of up to $25 per person. Should web site and its travel offerings (including confirmations) contain errors, including errors in pricing or package inclusions, the Operator reserves the right to correct any such errors, without limitation. Confirmations issued are likewise subject to modification and/or correction at any time prior to actual travel. Under no circumstances shall the Operator, its affiliates, employees, or vendors be held liable for any damage, including consequential or incidental damage, resulting from such errors or the correction thereof.

SAFETY

By offering reservations for travel in particular international destinations, Operator does not represent or warrant that travel to such areas is advisable or without risk. It is your responsibility to be aware of travel warnings and advisories as announced by the U.S. State Department. Should you choose to travel to a country that has been issued a travel warning or advisory, Operator will not be liable for damages or losses that result from travel to such destinations.

Please be aware that during your participation in vacations operated by Operator, certain risks and dangers may arise beyond our control, including but not limited to: the hazards of traveling in undeveloped areas; travel by boat, train, automobile, aircraft, or other means of transportation; the forces of nature; political unrest; acts of lawlessness or terrorism; and accident or illness in remote regions without means of rapid evacuation or medical facilities. You are voluntarily participating in these activities with the knowledge that there are significant dangers involved, and you hereby agree to accept any and all risks. As lawful consideration for the agreement with Operator to participate in such trips and activities you agree you will not make a claim against Operator, its related companies or its personnel or sue for bodily injury, emotional trauma, death, property loss or damage or other loss, cost or expense, however caused, as a result of or related to your contracting for, traveling to or from, or in any and every other way participating in the trip. You release Operator, its related companies and its personnel from any and all claims, known or unknown, arising from contracting for, traveling to or from, and in any and every way participating in a trip. Operator and its affiliates will not have liability regarding provision of medical care or the adequacy of any care that may be rendered. It is understood that Operator or its affiliate will use its best efforts to ensure that adequate measures are taken. You agree to be financially responsible for and to indemnify Operator for any and all costs related to medical treatment you may require on you trip. This release of liability and assumption of risk agreement and indemnification is entered into on behalf of you and all members of your family and party, also including minors. This agreement also binds your heirs, legal representatives and assigns.

Where the guest occupies a motor coach seat fitted with a safety belt, neither Operator nor the Supplier nor its agents or co-operating organizations or service providers will be liable for any injury, illness or death or for any loss or damages or claims whatsoever arising from any accident or incident, if the safety belt is not being worn at the time of such an accident or incident. This exclusion and limitation of liability shall not be used to imply that the Supplier or its agents or affiliated entities are liable in other circumstances.

ITINERARY CHANGES-CRUISES
In the event of water level problems on stretches of any river, it may be necessary to operate part of the itinerary by motorcoach. Operator reserves the right to change the itinerary whenever conditions, in the opinion of the Master of the Ship or local waterways regulations render it advisable or necessary. Operator or its affiliates will not be responsible for any loss or expense caused by reason of such changes.

Operator reserves the right to cancel, advance, or postpone any scheduled tour and/or sailing date and may, but is not obligated to, substitute another vessel, and shall not be liable for any loss whatsoever to tour/cruise participants by reason of any such cancellation, advancement, or postponement. In the event of cancellation by Operator only, tour/cruise participants’ only right of recourse shall be to a refund of monies paid to said operator in connection with such tour/cruise. In the event of charters of the vessels, strikes, lockouts, riots, or stoppage of labor for whatever cause or for any other reason whatsoever, Operator may at any time cancel, advance, or postpone any scheduled sailing and may, but is not obliged to, substitute another vessel and shall not be liable for any loss whatsoever to tour/cruise participants by reason of any such cancellation, advancement, or postponement.

PHOTOGRAPHS AND PICTURES
Photographs or pictures appearing on the web site should be used solely as an indication of facilities and attractions. Actual facilities and attractions may vary according to itinerary. Maps shown are current at the time of printing and may not reflect the actual tour routing should the itinerary change.

OPTIONAL EXCURSIONS & ACTIVITIES
The air carriers, accommodations, and other suppliers (referred to as “the Suppliers”) (including but not limited to trains, cruises, ferries, motorcoaches, hotels, and restaurants) providing optional activities and excursions (“the Services”) in the area of the vacation itinerary that are available for booking are not run, supervised, or controlled in any way by the Operator. These services are provided by local operators or other third parties that are entirely independent of the Operator, which has no control and has no right of control over the operations of these independent contractors.

Such activities and excursions do not form any part of the product or services sold to you by the Operator or of these Terms and Conditions, even where the Operator suggests particular operators/other third parties and/or assists you in booking such activities or excursions. Your contract for such activity or excursion will be with the organizer or operator of that activity or excursion and will be subject to its Terms and Conditions, which may contain exclusions or limitations of liability. The Operator has no liability for any such activity or excursion or for any act(s) or omission(s) of the organizer or operator or for any of its employees or agents or any other person(s) connected with the activity or excursion.

Any advice or assistance on or with any activity or excursion provided by any local representative does not mean or imply that the activity or excursion is sold, supervised, or controlled by the Operator or that any such advice or assistance is given on behalf of the Operator. Vacation participants are asked to check with the operator of any activity or excursion and the applicable Terms and Conditions before booking.

RESPONSIBILITY
Payment of the trip itinerary constitutes consent to all Legal policies and terms and conditions described here Operator and its employees, shareholders, representatives, and agents (hereinafter “Operator”) is a tour operator and uses third-party suppliers to arrange hotel accommodations, sightseeing, tours and transportation, whether by air, railroad, motorcoach, steamship, boat or other means. Operator is an independent contractor and is not an employee, agent or representative of any of these suppliers. Operator does not own, manage, operate, supervise, or control any transportation, vehicle, airplane, hotel or restaurants, or any other entity that supplies services related to your tour. Operator is not affiliated with any other tour operator. All suppliers are independent contractors, and are not agents or employees or representatives of Operator. Neither the Operator nor any mentioned or unmentioned subagents/affiliates shall be held responsible for any personal injury, property damage or other loss a passenger incurs on any tour arising from acts or omissions by any air carrier, public transport company, hotel, car rental company, subcontractor or other person or organization, whether or not such company is rendering any services supplied on the tour. All tickets and vouchers are issued and supplied subject to the foregoing and to any and all terms and conditions under which transportation and services are provided, including the terms and conditions of the supplier. The Operator accepts no responsibility for losses or expenses, including refunds of any money paid, due to delay or changes in schedules, cancellations or flight misconnections due to mechanical problems, sickness, quarantine, weather, acts of God, strikes, government actions, war, terrorism, epidemic, pandemic, illness, physical injury, quarantine, medical or customs or immigration regulation, or other circumstances beyond its control. Passengers must bear all such losses or expenses. To guard against unforeseen circumstances, we recommend you purchase our optional travel protection plan offered with each booking. The Operator reserves the right to alter prices at any time prior to departure and without prior notice if circumstances so warrant. Any devaluation or revaluation of currencies may affect published prices.

SAVING A VACATION

You will be able to save certain vacations to your account if you are not ready to book right away. Saving a vacation does not indicate that you are saving price. All products on this site are priced dynamically at the time of booking and a saved vacation will be repriced when you revisit it at any future date after saving it.

SHARING SAVED PAGES

You may choose to share a saved page with another person. In order to do that, you will need to have that persons email address. The person will receive a transactional email explaining that you have shared this page with them as well as a link to the saved page. Any use or abuse of this feature, will result in the termination of your account.

SEVERABILITY

If any provision of these terms and conditions shall be held unenforceable, such provision shall be struck and the remainder shall remain enforceable.

JURISDICTION AND APPLICABLE LAW

These Booking Conditions and any agreement to which they apply are governed in all respects by the laws of the state of New York without regard to conflict
